1. Scope of Services
1.1 EPC Legal Services Ltd, through Emilia Ciszewska, offers legal assistance as a McKenzie Friend and legal adviser in the field of family law.
1.2 Services include:
a. Legal information and procedural guidance;
b. Assistance with document drafting and preparation;
c. Support in case organisation and court preparation;
d. Quiet support and assistance at court hearings (subject to judicial discretion).
1.3 EPC Legal Services Ltd does not:
a. Act as or represent a solicitor or barrister;
b. Conduct litigation or hold client funds;
c. Provide legal services in a reserved capacity.
1.2 The scope of services for each client engagement will be set out in a written agreement or invoice before commencement of work.
2. Professional Status
2.1 Emilia Ciszewska holds legal qualifications including an Bachelor of Laws (LL.B), Master of Laws (LL.M), and has completed the Bar Professional Training Course (BPTC).
She is not a practising solicitor or barrister) nor does she represent clients in the same capacity as solicitors or barristers. Instead, EPC Legal Services Ltd provides a McKenzie Friend service (the Service) to litigants in person, including individuals and small to medium-sized enterprises, who are involved with or considering involvement in Family Court or Civil Court proceedings.
2.2 The Service is intended solely to assist and support clients with procedural guidance, document preparation, and quiet assistance during court hearings. EPC Legal Services Ltd does not provide formal legal advice or advocacy and is not a substitute for regulated legal representation.
2.3 Clients acknowledge that any information or support provided by EPC Legal Services Ltd is given in good faith but does not constitute legal advice. EPC Legal Services Ltd accepts no responsibility or liability for any loss, damage, or adverse outcome resulting from the use or reliance on the Service. Clients remain fully responsible for their own decisions and actions in relation to their legal matters.
3. Availability and Communication
3.1 Appointments are offered Monday to Friday, 9:00 am to 6:00 pm. Communication outside these hours is available only by prior agreement.
3.2 Clients may contact EPC Legal Services Ltd via email or telephone. Reasonable efforts will be made to respond promptly during business hours.
4. Fees and Payment
4.1 Standard hourly rate: £100/hr, billed in 15-minute increments unless otherwise agreed.
4.2 Fixed fees may be agreed in advance and confirmed in writing.
4.3 All fees must be paid in advance unless agreed otherwise.
4.4 Payment methods include bank transfer (no VAT charged).
4..5 Invoices must be settled before work commences unless otherwise stated. A cancellation fee of £150 may apply if a pre-booked court hearing is cancelled by the client.
5. Confidentiality and Data Protection
5.1 Client information is confidential and will not be disclosed without express consent, unless required by law.
5.2 EPC Legal Services Ltd is registered with the Information Commissioner's Office (ICO) and complies with data protection legislation.
6. Limitation of Liability
6.1 Services are delivered with reasonable skill and care but no guarantee of outcome is provided.
EPC Legal Services Ltd shall not be liable for:
a. Client decisions or actions;
b. Loss of earnings, business or opportunities;
c. Any consequential or indirect losses.
7. Intellectual Property
7.1 All materials created by EPC Legal Services Ltd remain the company’s intellectual property unless agreed otherwise. Materials may not be reproduced, distributed or used commercially without written permission.
8. Website Use
8.1 Use of the EPC Legal Services Ltd website is at the user’s risk. No guarantees are made as to accuracy of information. Users should seek regulated legal advice when necessary.
8.2 Unauthorised use of website content is prohibited. Any breach may lead to termination of site use rights.
9. Client Responsibilities
9.1 Clients agree to:
a. Provide accurate and honest information;
b. Cooperate fully throughout the support process;
c. Make timely payments and meet agreed deadlines.
10. Ownership of Client Documents
10.1 All documents received from clients are considered electronic copies, typically sent via email. These remain the client's property. Once the requested work has been completed, EPC Legal Services Ltd will permanently delete all received electronic documents. No documents will be stored or archived. Clients are responsible for maintaining their own records, as EPC Legal Services Ltd does not retain copies after the conclusion of services.
11. Cancellation and Termination
11.1 Clients may cancel services at any time in writing. All fees up to the date of cancellation are payable.
11.2 EPC Legal Services Ltd may terminate services with written notice in cases of non-cooperation, breach of terms, or unethical conduct.
12. Complaints Procedure
12.1 Complaints should be made in writing. All complaints will be investigated within 14 days and resolved fairly.
13. Governing Law
13.1 These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
14. Amendments
14.1 EPC Legal Services Ltd reserves the right to modify these terms at any time. Clients will be notified of material changes.
15. Confirmation of Agreement
15.1 By engaging EPC Legal Services Ltd, the client confirms they understand and accept these terms and acknowledge the limited and non-regulated nature of the service.
